These Terms of Service ("Terms") govern the use of services provided by TLSServers. By purchasing, accessing, or using any TLSServers services, you agree to be bound by these Terms.
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, the additional provisions in Section 28 (EU/EEA & UK Addendum) apply to you and take precedence over conflicting provisions where required by applicable law.
1. Services Provided
TLSServers provides hosting-related services including game server hosting, VPS hosting, dedicated server hosting, managed hosting, and related infrastructure services.
2. Eligibility
- You must be at least 18 years old or have permission from a parent or legal guardian.
- You must have the legal authority to agree to these Terms.
- You must provide accurate and complete account and billing information.
3. Account Responsibility
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity under your account.
- You must keep your billing and contact information accurate and current.
- Sharing account access with third parties is done at your own risk.
4. Acceptable Use
You may not use TLSServers services for:
- Illegal activity or unlawful content
- Malware, phishing, fraud, or malicious software
- DDoS attacks, network abuse, or traffic amplification
- Unauthorized access attempts, hacking, scanning, or exploitation
- Harassment, threats, abuse, or malicious behavior
- Excessive resource usage beyond purchased plan limits
- Any activity that negatively impacts our systems, network, customers, or reputation
5. Payments & Billing
- All services are billed in advance unless otherwise agreed in writing.
- Failure to pay may result in suspension, termination, or data removal.
- Payments are non-refundable unless otherwise stated in writing.
- Partial-month refunds are not provided.
- Refunds are not issued for abuse, policy violations, or voluntary cancellation.
EU/EEA & UK customers: Statutory cancellation and refund rights under EU consumer law and the UK Consumer Rights Act may apply. See Section 28.
6. Chargebacks & Payment Disputes
Fraudulent chargebacks or payment disputes may result in immediate suspension or termination of services. Any outstanding balances, dispute fees, or related costs may become immediately due.
7. Suspension & Termination
TLSServers reserves the right to suspend, restrict, or terminate services at its discretion for violations of these Terms, non-payment, abuse, fraud, security risks, network abuse, or conduct that negatively impacts company operations.
EU/EEA & UK customers: Where termination is not due to your breach, we will provide reasonable advance notice where practicable.
8. Data & Backups
Clients are solely responsible for maintaining backups of their data. TLSServers does not guarantee preservation, restoration, or recovery of data and is not liable for data loss, corruption, deletion, downtime-related issues, or third-party software failures.
9. Service Availability
While we strive to maintain high uptime, uninterrupted service is not guaranteed. Maintenance, hardware failures, upstream outages, attacks, or other unforeseen circumstances may cause service interruptions. Any uptime guarantees or credits are governed only by the applicable SLA, if provided.
10. Limitation of Liability
To the maximum extent permitted by law, TLSServers is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunity, goodwill, or data.
TLSServers's total liability for any claim shall not exceed the amount actually paid by the client for the affected service during the thirty (30) days before the claim.
EU/EEA & UK customers: Nothing in these Terms excludes or limits liability that cannot be excluded under applicable EU or UK law, including liability for death or personal injury caused by negligence, fraud, or statutory consumer rights.
11. Disclaimer of Warranties
Services are provided on an "AS IS" and "AS AVAILABLE" basis. TLSServers makes no warranties, express or implied, regarding availability, performance, compatibility, security, fitness for a particular purpose, or error-free operation.
12. Indemnification
Clients agree to indemnify, defend, and hold harmless TLSServers, its owners, staff, contractors, affiliates, and partners from claims, damages, liabilities, losses, or expenses arising from misuse of services, violation of these Terms, illegal conduct, abuse, or third-party claims related to client content or activity.
13. Privacy & Security
TLSServers takes reasonable measures to protect customer information and infrastructure. However, no online service can guarantee absolute security. Clients acknowledge the risks associated with internet-based services.
The collection and processing of personal data is governed by our Privacy Policy, which forms part of these Terms. EU/EEA and UK customers should refer to the EU/UK Privacy Addendum within the Privacy Policy.
14. Intellectual Property
- You may not use TLSServers branding without permission.
- You may not misrepresent affiliation with TLSServers.
- You may not copy, reproduce, or redistribute company materials without authorization.
- All company branding, logos, materials, and systems remain property of TLSServers.
15. Governing Law
For customers outside the EU/EEA and UK: These Terms shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict-of-law principles.
For EU/EEA and UK customers: These Terms are governed by Florida law to the extent permitted. However, you retain the benefit of any mandatory consumer protection provisions of the law of your country of habitual residence.
16. Dispute Resolution & Arbitration
Before initiating legal proceedings, both parties agree to attempt good-faith resolution of any dispute arising from these Terms or the use of services provided by TLSServers.
Any dispute, claim, or controversy arising out of or relating to these Terms, services, billing, suspension, termination, or platform usage shall be resolved through binding arbitration conducted in the State of Florida, except where prohibited by law.
Clients waive any right to participate in class-action lawsuits or class-wide arbitration against TLSServers, its owners, staff, contractors, affiliates, or partners.
If any portion of this arbitration provision is found unenforceable, any legal action must be brought exclusively in the state or federal courts located in Florida, and clients consent to the jurisdiction of such courts.
EU/EEA & UK customers: The arbitration clause and class action waiver do not apply where prohibited by EU or UK law. You may bring disputes before the courts of your country of habitual residence and may access ADR mechanisms available in your jurisdiction.
17. Changes to Terms
We may update these Terms at any time. Continued use of our services after updates constitutes acceptance of the revised Terms.
EU/EEA & UK customers: We will provide reasonable advance notice of material changes. Continued use after the notice period constitutes acceptance.
18. Entire Agreement
These Terms constitute the entire agreement between TLSServers and the client regarding use of services and supersede any prior verbal or written agreements relating to such services.
19. Abuse Toward Staff
Harassment, threats, intimidation, discrimination, excessive abuse, malicious conduct, or repeated disruptive behavior directed toward TLSServers staff, contractors, affiliates, partners, or customers may result in immediate suspension or termination of services without refund.
20. No Guarantee of Service Compatibility
TLSServers does not guarantee compatibility with any third-party software, plugins, modifications, operating systems, game versions, customer configurations, or external services.
21. Force Majeure
TLSServers shall not be liable for delays, interruptions, outages, failures, or damages caused by events beyond reasonable control, including but not limited to natural disasters, cyberattacks, upstream provider failures, labor disputes, war, terrorism, governmental actions, internet disruptions, hardware shortages, or power outages.
22. Customer Responsibility for Security
Clients are responsible for securing their own applications, passwords, game server configurations, software installations, API keys, and account access credentials.
TLSServers shall not be liable for damages resulting from weak passwords, insecure software, customer misconfiguration, third-party plugins, compromised customer systems, or unauthorized access caused by customer negligence.
23. Service Modifications
TLSServers reserves the right to modify, discontinue, replace, update, or reconfigure services, pricing, infrastructure, hardware, software, or service offerings at any time without liability.
EU/EEA & UK customers: We will provide reasonable advance notice of material service changes where practicable.
24. Electronic Communications
By using our services, clients consent to receive communications electronically, including invoices, service notices, support communications, maintenance notifications, policy updates, abuse notices, and legal notices.
25. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
26. Waiver
Failure by TLSServers to enforce any provision of these Terms shall not constitute a waiver of any rights or provisions.

Join our Discord28. EU/EEA & UK Customer Addendum
This addendum applies to customers located in the European Economic Area (EEA), United Kingdom, or Switzerland (collectively "EU/EEA & UK customers"). In the event of any conflict between this Addendum and the general Terms above, this Addendum takes precedence for EU/EEA & UK customers to the extent required by applicable law.
28.1 Legal Basis for Contract
Our contract with you is formed when you purchase or activate services. By accepting these Terms, you enter into a binding agreement with TLSServers for the provision of digital hosting services.
28.2 Right of Withdrawal (14-Day Cooling-Off Period)
If you are a consumer (not purchasing for business purposes) in the EU/EEA or UK, you have the right to withdraw from this contract within 14 days of entering into it without giving any reason, under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013.
By requesting that we begin providing services before the 14-day withdrawal period expires, you acknowledge that your right of withdrawal will be lost once the service has been fully performed. For partially performed services, a proportional charge applies.

28.3 Consumer Protection
EU/EEA consumers retain all rights granted by mandatory consumer protection legislation in their country of habitual residence, including rights under the EU Consumer Rights Directive and the Unfair Contract Terms Directive. UK consumers retain rights under the Consumer Rights Act 2015 and related legislation. Nothing in these Terms limits or waives those rights.
28.4 Pricing & VAT Transparency
All prices displayed to EU/EEA and UK customers are inclusive of applicable VAT where required by law. Any applicable taxes will be shown clearly at checkout before purchase.
28.5 Dispute Resolution for EU/EEA & UK Customers
EU customers may submit disputes to the European Commission's Online Dispute Resolution (ODR) platform at: ec.europa.eu/consumers/odr .
UK customers may contact the Citizens Advice consumer helpline or use an approved ADR scheme. We are not obligated to participate in ADR but will consider such requests in good faith.
EU/EEA and UK customers may bring proceedings before the courts of their country of habitual residence.
28.6 Data Protection
The processing of personal data for EU/EEA customers is governed by the General Data Protection Regulation (GDPR) (EU) 2016/679. For UK customers, the UK GDPR and Data Protection Act 2018 apply. Please refer to our Privacy Policy and its EU/UK Addendum for full details of your rights and our obligations.
28.7 Digital Services Act (EU) Compliance
TLSServers complies with applicable obligations under the EU Digital Services Act (DSA) where applicable. We will provide transparency and due process in any content moderation or account termination decisions affecting EU customers.
28.8 Governing Law (EU/EEA & UK)
While these Terms are governed by Florida law, EU/EEA customers benefit from the mandatory consumer protection laws of their country of habitual residence and may bring legal proceedings in the courts of their EU member state. UK customers benefit from the mandatory protections of UK consumer law and may bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland as appropriate.
